Q. I was injured in a traffic accident that was the other driver’s fault. Do I need a lawyer?

A. Possibly. Your need for a lawyer in this situation is directly proportional to the severity of your injury. For example, if your doctor says that you are fully recovered and your medical bills are only a few hundred dollars, you may be able to handle this claim yourself without involving an attorney. On the other hand, if you have several thousands of dollars in medical bills or lost wages from time you missed from work because of the accident, you should consult an attorney.
This is so because insurance companies generally seek to limit the amount of money they pay people for their claims. Attorneys who practice in this area are professionals who are familiar with the insurance companies’ tactics and know when their clients are being taken advantage of. If you are not a trained professional in this area, you risk being short-changed by an insurance company that is looking out for its interests and not yours. In cases where your total damages are only a few hundred dollars, this risk in terms of dollars is small. The risk and therefore the need for professional advice increases with the severity of the case.

Q. The other driver’s insurance company adjuster wants me to sign information release forms. Do I have to do this?

A. No. You should not sign any forms before an attorney has looked them over first and has advised you of the legal consequences.

Q. The other driver’s insurance company adjuster called and said they want me to give a recorded statement over the telephone. Do I have to do this?

A. No. If you are feeling pressured by an insurance adjuster and are uncomfortable about this, you should contact an attorney.

Q. If I talk to a lawyer isn’t he automatically entitled to a portion of my claim?

A. No. A good lawyer should be willing to speak to you without any obligation on your part. The lawyer should explain to you your rights and the fee he will charge you for any legal work. He should answer your questions to your satisfaction. You may then decide whether or not you wish to hire that attorney.
