Habitual Offender

If you were adjudicated an habitual offender in Virginia you may request a copy of your driving record from Virginia DMV which will show when you are eligible for reinstatement. Upon eligibility, you may have your privilege to operate a motor vehicle reinstated by the Circuit Court where you reside. If you reside outside of Virginia, you must bring your petition in the Circuit Court for the City of Richmond.

In most cases, once the petition is filed you will be referred to an Alcohol Safety Action Program for evaluation to determine whether you have substance abuse problems. The ASAP counselor will seek to verify your abstinence from alcohol in recent years. If you are statutorily eligible for reinstatement and ASAP gives you a clean bill of health, then the Court will in all likelihood grant your petition after a hearing.
